Terms of Service

These Terms of Service ("Terms") govern your use of the PandaStudio platform (the "Service") operated by:

These Terms are issued under Act No. 89/2012 Coll., the Civil Code of the Czech Republic (the "Civil Code"), and Act No. 634/1992 Coll., on Consumer Protection.

2.1. By accessing or using the Service, you enter into a binding contract with the Company and agree to be bound by these Terms. If you do not agree, you must not use the Service.

2.2. You must be at least 18 years of age to use the Service. By registering you represent and warrant that you meet this requirement and are legally competent to enter into a binding contract under the law applicable to you.

2.3. We may amend these Terms at any time. Material changes take effect no earlier than 14 days after we notify you by email or in the Service, during which period you may terminate the contract without penalty if you do not agree to the change. Continued use of the Service after that period constitutes acceptance of the amended Terms.

3.1. The Service is a back-office management platform that allows webcam studios and models to track multi-platform earnings, request payouts, and manage operational workflows. The Service does not host streaming content.

3.2. The Service facilitates integrations with third-party cam platforms (Chaturbate, LiveJasmin, and others). The Company is not responsible for the availability, policies, or conduct of those third parties. Your use of any third-party platform is governed by that platform's own terms.

3.3. Rates, payout schedules, and commissions displayed in your dashboard form part of this contract.

4.1. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately on Telegram @Pandastudiolive if you suspect unauthorized access.

4.2. You must provide accurate and current registration information and keep it up to date, including for identity verification (AML/KYC) purposes where required.

4.3. You must not use the Service for any unlawful purpose or in violation of any applicable law or regulation (including Czech and EU law, and the laws of your country of residence).

4.4. You are solely responsible for the content you upload and warrant that you hold all rights necessary to upload and use such content.

5.1. Earnings are aggregated from third-party platforms and displayed in your dashboard. The Company's studio commission is deducted in accordance with the rate displayed to you at registration or in platform-specific agreements.

5.2. Payouts are processed according to the schedule shown in your dashboard (typically twice per month). We may modify the schedule with at least 14 days' prior notice.

5.3. Early withdrawals may be available subject to a processing fee of 6–9 %, shown at the time of the request.

5.4. You are solely responsible for the taxation of amounts you receive through the Service in your country of tax residence. The Company does not provide tax advice.

5.5. The Company may withhold payouts during a reasonable investigation of suspected fraud, AML issues, or breach of these Terms. Any withheld amounts will be released or forfeited based on the outcome of the investigation.

6.1. If you are a consumer within the meaning of Act No. 634/1992 Coll., you have the statutory rights set out in Czech and EU consumer protection law, which are not restricted by these Terms.

6.2. As the Service consists of digital content supplied immediately upon registration with your express consent, you expressly acknowledge that, under § 1837(l) of the Civil Code, your statutory right to withdraw from the contract within 14 days does not apply once performance has begun.

6.3. Out-of-court resolution of consumer disputes: The Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate — ADR Department, Štěpánská 44, 110 00 Praha 1, www.coi.cz, is competent for out-of-court resolution of consumer disputes arising from this contract. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

7.1. The Service, its design, source code, text, and branding are protected by Czech and international copyright, trademark, and database rights, owned by or licensed to the Company.

7.2. You retain ownership of content you upload. By uploading it you grant the Company a worldwide, non-exclusive, royalty-free licence to host and process such content solely for the purpose of providing the Service.

8.1. You may terminate the contract at any time by deleting your account from the Service (Settings → Delete Account) or by messaging us on Telegram @Pandastudiolive. Outstanding earnings will be paid out on the next regular payout date, subject to minimum thresholds.

8.2. We may suspend or terminate your account immediately for material breach of these Terms, fraud, or where required by law.

9.1. To the maximum extent permitted by Czech law, the Company's aggregate liability arising out of or in connection with the Service is limited to the total studio commissions paid by you to the Company in the twelve (12) months preceding the event giving rise to the claim.

9.2. Nothing in these Terms limits liability for damage caused intentionally or by gross negligence, or any other liability that cannot be limited under Czech mandatory law.

9.3. The Company is not liable for any act or omission of any third-party platform integrated with the Service.

Processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

11.1. These Terms are governed by the laws of the Czech Republic, excluding its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11.2. Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Czech courts, specifically the court of general jurisdiction of the Company, save for mandatory consumer jurisdictions.
